1. Acceptance of Terms

By accessing or using OrcaClip ("the application", "the platform", "we", "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use OrcaClip.

2. Description of Service

OrcaClip is a content automation platform that enables users to:

• Download YouTube videos for personal content creation purposes
• Automatically generate short-form video clips using AI-powered viral scoring
• Add word-by-word subtitles and hook text overlays to clips
• Schedule and publish clips to Facebook, Instagram, and TikTok via their respective official APIs
• Back up generated clips to personal cloud storage (MEGA)

3. Eligibility

You must be at least 13 years of age to use OrcaClip. By using OrcaClip, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

4. User Responsibilities

As a user of OrcaClip, you agree to:

• Only download and clip YouTube videos for which you have the right to use and republish
• Comply with YouTube's Terms of Service regarding video downloads and reuse
• Comply with Meta's Platform Terms when posting content to Facebook and Instagram
• Comply with TikTok's Terms of Service when posting content to TikTok
• Not use OrcaClip to post content that is illegal, harmful, defamatory, or infringing
• Not use OrcaClip to spam, harass, or post misleading content
• Keep your access tokens and credentials secure and not share them with unauthorized parties

5. Content Ownership

You retain full ownership of the content you create and publish using OrcaClip. OrcaClip does not claim any intellectual property rights over your content.

You are solely responsible for ensuring that content you process through OrcaClip does not infringe the intellectual property rights of third parties, including the original YouTube content creators.

6. Third-Party Platform Compliance

OrcaClip integrates with third-party platforms (Meta, TikTok, YouTube, MEGA). Your use of these integrations is subject to their respective terms of service:

• Facebook Terms of Service
• TikTok Terms of Service
• YouTube Terms of Service

OrcaClip is not responsible for any actions taken by these platforms regarding your account or content, including account suspension or content removal.

7. TikTok API Usage

OrcaClip uses the TikTok Content Posting API to upload and schedule videos on behalf of users. By connecting your TikTok account to OrcaClip, you authorize OrcaClip to:

• Upload videos to your TikTok account as directed by you
• Publish or schedule videos on your behalf using the video.upload and video.publish scopes

You may revoke this authorization at any time through TikTok's Connected Apps settings.

8. Disclaimer of Warranties

OrcaClip is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the application will be error-free, uninterrupted, or that it will meet your specific requirements.

9. Limitation of Liability

To the fullest extent permitted by applicable law, OrcaClip and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application, including but not limited to loss of content, account suspension by third-party platforms, or missed posting schedules.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue OrcaClip at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of OrcaClip after changes constitutes your acceptance of the new terms. We will update the "Last updated" date at the top of this page when changes are made.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
